These Terms of Service ("Terms", "Agreement") constitute a legally binding agreement between you ("User", "you", "your") and Quantum Pivot Ltd, a company registered in England and Wales ("Company", "Quantum Pivot", "we", "our", or "us"), governing your access to and use of the Max mobile application ("App", "Service").

IMPORTANT LEGAL NOTICE - READ BEFORE USING:

BY DOWNLOADING, INSTALLING, ACCESSING, OR USING THE APP, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE TO THESE TERMS IN THEIR ENTIRETY, YOU MUST NOT DOWNLOAD, INSTALL, ACCESS, OR USE THE APP.

THIS APP IS A GUIDANCE TOOL ONLY AND DOES NOT PROVIDE VERIFIED, FACTUAL, OR SCIENTIFICALLY ACCURATE INFORMATION. QUANTUM PIVOT LTD EXPRESSLY DISCLAIMS ALL LIABILITY FOR ANY HARM TO YOUR PET(S). YOU ASSUME ALL RISK.

1. ACCEPTANCE OF TERMS AND CONDITIONS

By accessing or using the App, you represent and warrant that:

You are at least eighteen (18) years of age, or if you are between thirteen (13) and seventeen (17) years of age, you have obtained verifiable parental or legal guardian consent to these Terms;
You have the legal capacity and authority to enter into this binding Agreement;
You will comply with all applicable local, national, and international laws and regulations;
You understand and acknowledge that Max provides general guidance only and is not a source of verified, factual, or scientifically accurate information;
You accept full and sole responsibility for all decisions regarding your pet's diet, nutrition, and health;
You will consult a qualified, licensed veterinarian before making any dietary or health decisions for your pet;
You understand that Quantum Pivot Ltd accepts no responsibility or liability whatsoever for any consequences arising from your use of the App;
You have read and agree to be bound by these Terms in their entirety.

2. DESCRIPTION OF SERVICE

Max is a pet food guidance application designed solely to provide general, non-professional opinions about pet food products. The App enables you to:

Scan pet food product barcodes to view non-verified ingredient analysis and subjective ratings;
Create and manage pet profiles;
Track your product scanning history;
Search for pet food products (Max+ subscribers only);
Submit products not currently in our database.

The App is not a veterinary service, nutritional consultancy, or medical device. No information provided by the App should be construed as professional advice of any kind.

3. ACCOUNT REGISTRATION

3.1 Account Creation

Access to certain features requires account registration via Apple Sign-In or Google Sign-In. You agree to provide accurate, current, and complete information during registration.

3.2 Account Security and Responsibility

You are solely responsible for:

Maintaining the confidentiality and security of your account credentials;
All activities occurring under your account, whether or not authorised by you;
Immediately notifying us of any unauthorised access or security breach;
Any losses or damages arising from your failure to maintain account security.

We shall not be liable for any loss or damage arising from your failure to comply with these security obligations.

4. SUBSCRIPTION SERVICES (MAX+)

4.1 Subscription Plans

Max+ premium subscription provides enhanced features. Available plans:

Weekly: Auto-renewing, billed every seven (7) days
Monthly: Auto-renewing, billed every calendar month
Yearly: Auto-renewing, billed every twelve (12) months

4.2 Billing, Renewal, and Cancellation

Payment will be charged to your Apple ID account immediately upon confirmation of purchase;
Subscriptions automatically renew unless auto-renewal is disabled at least twenty-four (24) hours before the end of the current billing period;
Your account will be charged for renewal within twenty-four (24) hours prior to the end of the current period;
You may manage and cancel subscriptions through your Apple ID Account Settings;
Any unused portion of a free trial period will be forfeited upon subscription purchase;
No refunds or credits will be provided for partial subscription periods, upgrades, or downgrades.

4.3 Price Modifications

We reserve the right to modify subscription pricing at any time. Price changes will apply to subsequent billing cycles following notice to you.

4.4 Refund Policy

All subscription and in-app purchase transactions are processed by Apple. To request a refund, please visit reportaproblem.apple.com. Your statutory rights under applicable consumer protection laws are not affected.

5. FREE TIER LIMITATIONS

Non-subscribing users are limited to three (3) product scans per calendar month. We reserve the right to modify free tier limitations at any time without notice.

6. USER CONTENT AND INTELLECTUAL PROPERTY ASSIGNMENT

6.1 User Submissions

You may submit content to the App including, without limitation, pet photographs, product photographs, product information, feedback, suggestions, and reports ("User Content").

6.2 Licence Grant and Assignment of Rights

IMPORTANT - PLEASE READ CAREFULLY:

By submitting any User Content to the App, including but not limited to photographs submitted through the self-scan feature, you hereby:

Grant to Quantum Pivot Ltd a perpetual, irrevocable, worldwide, royalty-free, fully paid-up, non-exclusive, transferable, sublicensable licence to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, publicly perform, publicly display, and otherwise exploit such User Content in any and all media formats and channels now known or hereafter developed, without further notice to, or consent from, you, and without any requirement of attribution or compensation to you or any third party;
Acknowledge and agree that this licence shall survive the termination or deletion of your account, and that Quantum Pivot Ltd shall retain all rights granted herein in perpetuity;
Waive any and all moral rights you may have in User Content to the fullest extent permitted by applicable law;
Represent and warrant that you own or have obtained all necessary rights, licences, consents, and permissions to grant the foregoing licence, and that the User Content does not infringe upon the intellectual property rights, privacy rights, or any other rights of any third party;
Acknowledge that you shall have no right to request deletion, removal, or return of User Content once submitted, and that Quantum Pivot Ltd may retain and use such content indefinitely regardless of your account status.

6.3 User Content Standards

You represent and warrant that User Content shall not:

Be false, misleading, deceptive, or fraudulent;
Infringe upon any third party's intellectual property, privacy, publicity, or other proprietary rights;
Contain unlawful, defamatory, libellous, threatening, abusive, harassing, or objectionable material;
Contain viruses, malware, or other harmful code;
Violate any applicable laws, regulations, or third-party rights.

6.4 Content Moderation and Removal

We reserve the sole and absolute right to review, moderate, refuse, or remove any User Content at any time, for any reason or no reason, without notice or liability to you.

7. THIRD-PARTY PRODUCTS AND MANUFACTURER DISCLAIMER

7.1 OPINION AND FAIR COMMENT

ALL PRODUCT RATINGS, ANALYSES, SCORES, REVIEWS, AND COMMENTARY PROVIDED THROUGH THE APP CONSTITUTE PROTECTED OPINION, FAIR COMMENT, AND HONEST CRITICISM UNDER APPLICABLE LAW.

You acknowledge and agree that:

All information, ratings, scores, and analyses regarding third-party products (including but not limited to pet food products, treats, and supplements) represent the subjective opinions, commentary, and fair criticism of Quantum Pivot Ltd;
Such opinions are not statements of fact and are provided for informational and educational purposes only;
Quantum Pivot Ltd exercises its right to free speech, fair comment, and honest opinion regarding products available in the public marketplace;
Product manufacturers, distributors, retailers, and any other third parties have no claim, right of action, or cause of action against Quantum Pivot Ltd arising from the publication of opinions, ratings, or analyses of their products.

7.2 No Affiliation with Manufacturers

Quantum Pivot Ltd is an independent company with no affiliation, endorsement, sponsorship, partnership, or business relationship with any pet food manufacturer, brand, distributor, or retailer whose products may appear in the App. All trademarks, trade names, logos, and brand names appearing in the App are the property of their respective owners and are used solely for identification and informational purposes.

7.3 Waiver of Claims by Third Parties

To the extent any manufacturer, brand, company, or third party accesses or uses the App, or has products featured within the App, such party hereby:

Waives any and all claims against Quantum Pivot Ltd for defamation, libel, slander, trade libel, product disparagement, tortious interference, unfair competition, or any similar cause of action;
Acknowledges that all ratings and analyses constitute protected opinion and fair comment on matters of public interest (pet nutrition and consumer welfare);
Consents to the inclusion of their products in the App's database and to the publication of opinions regarding such products;
Releases Quantum Pivot Ltd from any liability arising from the display or analysis of their products.

7.4 User-Submitted Product Information

Where product information has been submitted by users of the App, Quantum Pivot Ltd:

Makes no representations or warranties regarding the accuracy of such information;
Is not responsible for any errors, omissions, or inaccuracies in user-submitted content;
Acts solely as a passive conduit for user-generated content and is protected as such under applicable laws;
Shall not be liable to any manufacturer or third party for user-submitted information.

7.5 Limitation on Third-Party Claims

No manufacturer, distributor, retailer, brand, company, or any third party shall have any right to bring any claim, lawsuit, demand, or action against Quantum Pivot Ltd, its officers, directors, employees, agents, or affiliates arising from:

The inclusion or exclusion of any product in the App;
Any rating, score, analysis, opinion, or commentary regarding any product;
Any user reviews, comments, or submissions regarding any product;
Any alleged inaccuracy in product information;
Any alleged damage to reputation, brand value, sales, or business relationships;
The methodology used to rate, analyse, or score products;
Any comparison between products or brands.

Any such third party accessing or interacting with the App in any manner irrevocably waives any such claims and agrees to indemnify Quantum Pivot Ltd against any costs, expenses, or damages arising from any breach of this waiver.

7.6 Public Interest Defence

Quantum Pivot Ltd asserts that all product information, ratings, and analyses published through the App:

Relate to matters of public interest, namely consumer welfare and pet health;
Are published in good faith for the benefit of consumers;
Constitute fair comment and honest opinion on publicly available products;
Are protected under applicable laws regarding free speech, fair comment, and consumer advocacy.

8. COMPANY INTELLECTUAL PROPERTY

8.1 Ownership

The App and all content, features, and functionality thereof, including but not limited to software, code, algorithms, databases, analysis methodologies, text, graphics, logos, icons, images, audio, video, and the selection and arrangement thereof ("Company IP"), are the exclusive property of Quantum Pivot Ltd or its licensors and are protected by copyright, trademark, patent, trade secret, and other intellectual property laws.

8.2 Limited Licence

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable licence to access and use the App solely for your personal, non-commercial purposes. This licence does not include any right to:

Modify, copy, distribute, transmit, display, perform, reproduce, publish, licence, create derivative works from, transfer, or sell any Company IP;
Reverse engineer, decompile, disassemble, or attempt to derive the source code of the App;
Remove, alter, or obscure any proprietary notices;
Use the App for any commercial purpose without prior written consent.

8.3 Reservation of Rights

All rights not expressly granted herein are reserved by Quantum Pivot Ltd. No licence or right is granted by implication, estoppel, or otherwise.

9. DISCLAIMERS AND EXCLUSIONS

9.1 GUIDANCE TOOL ONLY - NO FACTUAL REPRESENTATIONS

THE APP IS PROVIDED AS A GENERAL GUIDANCE TOOL ONLY. QUANTUM PIVOT LTD MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, REGARDING THE ACCURACY, COMPLETENESS, RELIABILITY, SUITABILITY, OR AVAILABILITY OF ANY INFORMATION PROVIDED THROUGH THE APP.

You expressly acknowledge, understand, and agree that:

All product analysis, ratings, scores, classifications, and information provided by the App constitute subjective opinions and general guidance only, and are not statements of fact;
The information provided is not verified, validated, or guaranteed to be accurate, complete, current, or correct;
The App does not provide and is not intended to provide veterinary advice, nutritional advice, medical advice, or any form of professional consultation;
Ingredient ratings and classifications represent subjective opinions that may not reflect current scientific research, consensus, or professional standards;
Product information may be outdated, incomplete, incorrect, or based on unverified user submissions;
You are solely and exclusively responsible for independently verifying all information by consulting qualified professionals and reviewing actual product packaging.

9.2 COMPLETE EXCLUSION OF LIABILITY FOR PET HEALTH

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, QUANTUM PIVOT LTD, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, SUCCESSORS, AND ASSIGNS EXPRESSLY DISCLAIM AND SHALL HAVE NO RESPONSIBILITY, LIABILITY, OR OBLIGATION WHATSOEVER FOR:

Any harm, injury, illness, disease, suffering, death, or any other adverse outcome to any pet, animal, or living creature;
Any dietary choices, feeding decisions, nutritional decisions, or health decisions made in reliance upon information provided by the App;
Any allergic reactions, digestive issues, nutritional deficiencies, health complications, or medical conditions;
Any inaccuracies, errors, omissions, or misrepresentations in product information, ingredient analysis, or ratings;
Your failure to consult a qualified, licensed veterinarian or other appropriate professional;
Any direct, indirect, incidental, consequential, special, exemplary, or punitive damages of any kind;
Any veterinary expenses, medical costs, treatment costs, or related expenses;
Any emotional distress, mental anguish, or psychological harm.

BY USING THIS APP, YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT YOU ASSUME ALL RISK AND ACCEPT FULL AND SOLE RESPONSIBILITY FOR ALL DECISIONS REGARDING YOUR PET'S DIET, NUTRITION, AND HEALTH. YOU HEREBY RELEASE AND FOREVER DISCHARGE QUANTUM PIVOT LTD FROM ANY AND ALL CLAIMS, DEMANDS, DAMAGES, LOSSES, COSTS, EXPENSES, AND LIABILITIES OF ANY KIND ARISING FROM OR RELATED TO YOUR USE OF THE APP.

9.3 Disclaimer of Warranties

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, QUANTUM PIVOT LTD EXPRESSLY DISCLAIMS ALL WARRANTIES, EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO:

IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT;
WARRANTIES ARISING FROM COURSE OF DEALING, COURSE OF PERFORMANCE, OR TRADE USAGE;
WARRANTIES THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS;
WARRANTIES THAT THE APP WILL MEET YOUR REQUIREMENTS OR EXPECTATIONS;
WARRANTIES REGARDING THE ACCURACY, RELIABILITY, COMPLETENESS, OR TIMELINESS OF ANY INFORMATION.

9.4 Product Information Disclaimer

You acknowledge and agree that product information in our database:

May be outdated, as manufacturers may change formulations without notice;
May be incomplete, inaccurate, or contain errors;
May be based on unverified user submissions;
May differ from actual product contents;
Should never be relied upon without independent verification.

You must always verify information by checking actual product packaging and consulting qualified professionals.

10. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

1. EXCLUSION OF DAMAGES: IN NO EVENT SHALL QUANTUM PIVOT LTD, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, SUCCESSORS, OR ASSIGNS BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) THE APP, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE, OR ANY OTHER LEGAL THEORY, EVEN IF QUANTUM PIVOT LTD HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

2. EXCLUSION OF PET-RELATED LIABILITY: QUANTUM PIVOT LTD SHALL HAVE NO LIABILITY WHATSOEVER FOR ANY HARM, INJURY, ILLNESS, OR DEATH TO ANY PET OR ANIMAL, OR FOR ANY VETERINARY EXPENSES, MEDICAL COSTS, OR RELATED DAMAGES.

3. MAXIMUM LIABILITY CAP: NOTWITHSTANDING ANY OTHER PROVISION OF THESE TERMS, QUANTUM PIVOT LTD'S TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY AND ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE APP SHALL NOT EXCEED THE LESSER OF: (A) THE TOTAL AMOUNT YOU ACTUALLY PAID TO QUANTUM PIVOT LTD FOR THE APP IN THE SIX (6) MONTHS IMMEDIATELY PRECEDING THE DATE THE CLAIM AROSE; OR (B) TEN POUNDS STERLING (£10.00).

4. ESSENTIAL BASIS: YOU ACKNOWLEDGE AND AGREE THAT THE LIMITATIONS OF LIABILITY SET FORTH IN THIS SECTION REFLECT A FAIR AND REASONABLE ALLOCATION OF RISK BETWEEN YOU AND QUANTUM PIVOT LTD, AND THAT THESE LIMITATIONS ARE AN ESSENTIAL BASIS OF THE BARGAIN BETWEEN THE PARTIES. QUANTUM PIVOT LTD WOULD NOT PROVIDE THE APP WITHOUT THESE LIMITATIONS.

11. ASSUMPTION OF RISK

You expressly acknowledge, understand, and agree that:

Your use of the App is entirely at your own risk;
You voluntarily assume all risks associated with using the App and relying on any information provided therein;
You are solely responsible for evaluating the suitability of any information for your specific circumstances;
You release Quantum Pivot Ltd from all liability arising from your use of the App;
No oral or written information or advice given by Quantum Pivot Ltd shall create any warranty or increase the scope of Quantum Pivot Ltd's obligations.

12. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Quantum Pivot Ltd, its officers, directors, employees, agents, affiliates, successors, assigns, licensors, and service providers (collectively, "Indemnified Parties") from and against any and all claims, demands, actions, suits, proceedings, losses, damages, liabilities, settlements, judgments, costs, and expenses (including reasonable attorneys' fees and court costs) arising out of or relating to:

Your access to or use of the App;
Your breach of these Terms or any representation or warranty contained herein;
Your violation of any applicable law, regulation, or third-party right;
Any User Content you submit, post, or transmit through the App;
Any dispute between you and any third party;
Any claim that your use of the App caused damage to a third party.

Quantum Pivot Ltd reserves the right, at your expense, to assume the exclusive defence and control of any matter for which you are required to indemnify us, and you agree to cooperate with our defence of such claims.

13. TERMINATION

13.1 Termination by You

You may cease using the App at any time. Account deletion requests should be directed to support@maxpet.app.

13.2 Termination by Company

Quantum Pivot Ltd may, in its sole and absolute discretion, suspend, restrict, or terminate your access to the App at any time, with or without cause, with or without notice, and without liability to you. Grounds for termination include, without limitation:

Violation of these Terms;
Fraudulent, abusive, or illegal activity;
Conduct harmful to other users, third parties, or Quantum Pivot Ltd;
Extended periods of inactivity;
Any other reason at our sole discretion.

13.3 Effect of Termination

Upon termination:

Your right to access and use the App shall immediately cease;
No refunds shall be provided for any prepaid subscription fees;
We may delete your account and associated data;
All licences granted to User Content shall survive termination in accordance with Section 6.2;
Sections 6.2, 7, 8, 9, 10, 11, 12, 16, 17, and 18 shall survive termination.

14. PROHIBITED CONDUCT

You agree not to:

Use the App for any unlawful purpose or in violation of any applicable law;
Attempt to gain unauthorised access to the App, other accounts, or computer systems;
Interfere with or disrupt the integrity or performance of the App;
Use automated means (including bots, scrapers, or spiders) to access the App;
Reverse engineer, decompile, disassemble, or attempt to derive source code;
Copy, modify, distribute, sell, lease, or create derivative works;
Circumvent any technological measures designed to protect the App;
Impersonate any person or entity;
Submit false, misleading, or fraudulent information;
Use the App in any manner that could damage, disable, or impair the App.

15. MODIFICATIONS

15.1 Modifications to Service

Quantum Pivot Ltd reserves the right to modify, suspend, or discontinue the App or any feature thereof at any time, with or without notice, and without liability to you.

15.2 Modifications to Terms

We reserve the right to modify these Terms at any time. Material changes will be notified through the App or by other reasonable means. Your continued use of the App following notification of changes constitutes acceptance of the modified Terms. If you do not agree to the modified Terms, you must discontinue use of the App.

16. GOVERNING LAW AND JURISDICTION

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to conflict of law principles. Any legal action or proceeding arising out of or relating to these Terms shall be brought exclusively in the courts of England and Wales, and you hereby irrevocably consent to the personal jurisdiction and venue of such courts.

17. GENERAL PROVISIONS

17.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Quantum Pivot Ltd regarding the App and supersede all prior agreements, representations, warranties, and understandings.

17.2 Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, such provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if modification is not possible, severed from these Terms, and the remaining provisions shall continue in full force and effect.

17.3 Waiver

No waiver of any term or condition of these Terms shall be deemed a further or continuing waiver of such term or any other term. Any failure to enforce any provision of these Terms shall not constitute a waiver of our right to subsequently enforce such provision.

17.4 Assignment

You may not assign, transfer, or sublicense any of your rights or obligations under these Terms without our prior written consent. We may freely assign, transfer, or delegate our rights and obligations without restriction or notice.

17.5 Third-Party Beneficiaries

These Terms do not create any third-party beneficiary rights, except as expressly set forth in Section 18 (Apple App Store Terms).

17.6 Force Majeure

Quantum Pivot Ltd shall not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, riots, labour disputes, governmental actions, internet outages, or third-party service failures.

17.7 Notices

Notices to you may be provided through the App, via email, or by posting on our website. Notices to us must be sent to support@maxpet.app.

17.8 Relationship of Parties

Nothing in these Terms shall be construed to create a partnership, joint venture, agency, or employment relationship between you and Quantum Pivot Ltd.

18. APPLE APP STORE TERMS

The following additional terms apply to users who download the App from the Apple App Store:

18.1 Acknowledgment

You acknowledge that this Agreement is between you and Quantum Pivot Ltd only, and not with Apple Inc. ("Apple"). Quantum Pivot Ltd, not Apple, is solely responsible for the App and its content.

18.2 Scope of Licence

The licence granted to you for the App is limited to a non-transferable licence to use the App on any Apple-branded device that you own or control and as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions.

18.3 Maintenance and Support

Quantum Pivot Ltd is solely responsible for providing any maintenance and support services with respect to the App. You acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the App.

18.4 Warranty

Quantum Pivot Ltd is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the App (if any) to you. Apple has no other warranty obligation whatsoever with respect to the App.

18.5 Product Claims

You acknowledge that Quantum Pivot Ltd, not Apple, is responsible for addressing any claims by you or any third party relating to the App, including: (i) product liability claims; (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.

18.6 Intellectual Property Claims

In the event of any third-party claim that the App infringes that third party's intellectual property rights, Quantum Pivot Ltd, not Apple, will be solely responsible for the investigation, defence, settlement, and discharge of any such claim.

18.7 Legal Compliance

You represent and warrant that: (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

18.8 Third-Party Beneficiary

You acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of this Agreement, and that, upon your acceptance, Apple will have the right to enforce this Agreement against you as a third-party beneficiary thereof.

18.9 Refunds and Statutory Rights

All purchases are processed by Apple. To request a refund, visit reportaproblem.apple.com. Your statutory rights under applicable consumer protection laws, including the UK Consumer Rights Act 2015 and the EU Consumer Rights Directive, are not affected by these Terms.
